The following Apartment Rules and Regulations are for the mutual benefit and information of all residents and are to be considered as an addendum to the Apartment Lease.

 
  Renewal

The Apartment Lease shall be renewed for a period of one (1) year unless either Lessee or Lessor, at least ( ) days prior to the expiration of the lease term, gives the other party notice in writing that the Apartment Lease shall not be renewed. It is necessary that Lessor receives adequate notice for renewal or termination by Lessee in order to accommodate the needs of current and future residents. All subsequent Apartment Lease or Offer & Acceptance of Lease Renewal document executed after the initial lease term will require the above referenced notification period be followed, unless otherwise agreed to in writing by all parties. Should Lessee desire subsequent lease term to be for a period less than one year, applicable lease terms may be available from the Property Manager. A new Apartment Lease or Offer & Acceptance of Lease Renewal document must be executed and properly signed upon any renewal.

 
  Move-In Check List

You, as Lessee, are provided a Move-in Check List to itemize the apartment condition and/or deficiencies. This List will serve as a permanent record of apartment condition and will be utilized in assessing apartment damage, if any, upon Lessee vacating the apartment. This List must be returned within 3 days of initial move-in to be considered a valid document.

 
  Move-Out Procedures

It is important that move-out processing be handled in a prompt manner to facilitate proper disposition of the security deposit. In addition to Lessee's fulfillment of the Apartment Lease and appropriate move-out notice be given or sent Lessor at the business office for the leased premises, it is required:
 a) All rent and any and all assessed fees be paid in full.
 b) The apartment be returned in good and clean and satisfactory condition excepting only normal wear and tear.
 c) All apartment and supplemental keys be returned to the Office on the specified move-out date previously scheduled with the Office.
 d) A forwarding address for all Lessees be delivered to the Office.
 e) All personal property of Lessee be removed upon vacating the premises. All personal property left by Lessee upon vacating the premises shall be deemed abandoned, and Lessor has the right to remove and dispose of same. Fees may be assessed for disposal and/or storage of Lessee’s property. No liability is assigned to the Lessor in the disposal of this property.

Note: The security deposit will be returned, if due, pro rata to all Lessees as signed on current Apartment Lease unless a signed agreement by all parties acknowledges a different allocation.

 
  Apartment Transfer

Lessee is not allowed to transfer to a different apartment on the property except on the anniversary of the Apartment Lease. Specific terms governing such a transfer are available in the Office.

 
  Conduct

Tenant shall not bring, or allow any of its guests to bring, onto the Premises, Common Areas, or the Facility any firearm, explosives, dangerous or hazardous substance or illegal drug(s) or alcohol. Tenant shall not allow more than 10 persons to be present in the Unit at any one time. Tenant shall cause all guests and visitors at the Premises or Facility to comply with all provision of this Lease (including without limitation the Rules & Regulations) regarding the use and occupancy of the Premises and the Facility. Tenant shall not us, or all its guests or visitors to use, the Premises or the Facility for any unlawful purpose, and shall not permit any loud noises or noxious odors to emanate from the unit.

Tenant understands that noise violations will be subject to the following fee structure:
First Violation- $150 fine assessed immediately.
Second Violation- $300 fine assessed immediately.
Third Violation- $450 fine assessed immediately.

Upon the third violation Tenant understands that Lessor may, at its right, avail itself of the rights and remedies defined in Section 13 of the Lease.

 
  Pets

Tenant shall not bring or allow any of its guests or visitors to bring, onto the Premises, Common Areas, or the Facility any animal except those that are required for medical purposes. Tenant further understands that cats, dogs, rabbits, and any animal more than one (1) pound in size is banned from the Unit, Premises, and Facility. Only those animals which can be permanently caged are permitted in the Unit.

Tenant understands that pet violations will be subject to the following fee structure:
First Violation- $300 fine assessed immediately.
Second Violation- $450 fine assessed immediately.
Third Violation- $600 fine assessed immediately.

Upon the third violation Tenant understands that Lessor may, at its right, avail itself of the rights and remedies defined in Section 13 of the Lease.

 
  Tanning Facility Policies

Use of the tanning facilities by Tenant is subject to the following guidelines:
 1) Persons using the tanning facilities do so at their own risk.
 2) Your failure to wear appropriate eye protection may result in permanent damage to your eyes. You agree to wear protective eyewear when using the tanning facility.
 3) Repeated exposure to ultraviolet light (whether from natural or artificial sources) causes burns and may result in premature aging and/or skin cancer.
 4) If you are taking a prescription or over the counter drug(s), you should consult a physician before using the tanning facilities.
 5) If you are pregnant, you should consult a physician before using the tanning facilities.
 6) You must comply with all applicable laws concerning use of the tanning facilities.
 7) Abnormal skin sensitivity or burning may be cause by reactions of ultraviolet light to certain foods, cosmetics, medications, or drugs. You should consult a physician before using the tanning facilities if you have any questions or concerns.
 8) You are responsible for understanding and abiding by all tanning facility regulations.

YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE WARNINGS STATED ABOVE AND YOU ACKNOWLEDGE AND UNDERSTAND THAT YOU ASSUME THE RISK FOR ANY INJURY (INCLUDING DEATH) OR ACCIDENT WHICH RELATES TO THE USE OR MISUSE OF THE TANNING FACILITY. YOU HEREBY AGREE TO WAIVE, RELEASE AND HOLD HARMLESS OWNER(S), LESSOR, AND AGENT OF THE APARTMENT COMMUNITY IN WHICH THE TANNING FACILITY IS LOCATED AS WELL AS THEIR PARTNERS, OFFICERS, EMPLOYEES, CONTRATORS AND AGENTS FROM ACTIONS, CLAIMS, COSTS, DAMAGES, DEMAND, EXPENSES AND LOSSES ARISING OUT OF OR RELATED TO THE TANNING FACILITY ITSELF AND/OR YOUR USE OR MISUSE OF THE TANNING FACILITY INCLUDING, WITHOUT LIMITATION, THE NEGLIGENT ACTIONS OR OMISSIONS OF THE FOREGOING RELEASE PARTIES.

 
  General Facility Policies
  • Campus Pointe amenity areas are considered private property and are designed for the use of Campus Pointe residents and their guests only.
  • All amenity areas are open from 7 AM to 11 PM daily.
  • Outdoor fires are prohibited in all areas except the approved grills located by the picnic areas and the fire pit by the clubhouse.
  • Possession, use, or distribution of alcohol, illegal drug(s), or controlled dangerous substances is prohibited.
  • Drinks in closed, resealable plastic containers are allowed. Glass containers are strictly prohibited.
  • Vehicles are not permitted on any amenity area. Residents will be charged for any damage caused to the lawns, equipment, or structures.
  • Gatherings of more than 30 people require prior written permission from Campus Pointe management.
  • Participants are responsible for any damages to the facilities and proper disposal of trash.
  • Participants are expected to exhibit proper conduct and respect the rights of others. Individuals who engage in unacceptable, unsafe, or irresponsible behavior may have their access to the facilities revoked, modified and/or subjected to the termination of the rental contract.
  • No person may deface, destroy, injure, misuse, or remove any Campus Pointe property from any facility or amenity.
     
      Outdoor Recreational Activities
  • All courts are open for play on a first come, first serve basis unless an activity is scheduled by the Campus Pointe management.
  • Dunking the basketball or grabbing the rim is strictly prohibited.
  • Skateboards, rollerblades, and bicycles are prohibited on the basketball courts and picnic shelters.
  • Bicycles are not permitted on the track.
  • Individuals participate at their own risk and assume responsibility for their own health and safety. Regency Management Service and Campus Pointe Apartments are not liable for injuries sustained during participation in any individual or property sponsored activity.
     
      Equipment Check Out
  • Only Campus Pointe residents and employees may check out equipment.
  • You must completely fill out and sign the equipment checkout form and liability waiver.
  • All equipment must be returned by 9 AM the next business day after the equipment is checked out.
  • If the equipment is not returned by the next business day at 9 AM, it will be considered lost or stolen and the resident will be charged the retail replacement cost.
  • Abusive use of equipment will not be tolerated. Users will be charged retail replacement cost for damaged equipment.
  • Equipment is checked out on a first come, first serve basis and may not be reserved.
     
      Parking

    Except for automobiles, sport utility vehicles, and pick-up trucks, no vehicles (including, without limitation, motorcycles, boats and boat trailers, campers, travel trailers, utility trailers, trucks, commercial vehicles, and motor homes) may be parked on the property without Lessor's prior written consent. All vehicles must be currently licensed and in good operating condition and must be parked only in the spaces provided for parking. No vehicle may be parked in front of dumpsters, blocking other vehicles, on the grass, outside the boundaries of a single designated parking space, or in entrances or exits. Any violations of the foregoing rules will subject the vehicle to being towed without notice at the vehicle owner's expense. Lessor is not liable for any damage arising as a result of towing. Lessee agrees to indemnify and hold Lessor harmless for any claims by Lessee's guests or invitees for the towing of their vehicles for violation of these rules; and Lessee acknowledges the responsibility to advise guests and invitees of the proper manner for the parking of their vehicles, and Lessee further agrees to ensure their compliance in each case. Lessor may impose additional parking regulations, including limiting the number of vehicles, requiring the use of parking decals on vehicles, and/or assigning parking spaces. No more than one vehicle is allowed for each Lessee without Lessor's prior written consent.

     
      Grills

    Local fire regulations and Campus Pointe Apartments prohibit the storage and use of personal charcoal or gas grills on the property. Resident may use the charcoal grills provided in the amenity areas.

     

    The terms and conditions of the Apartment Lease and the Rules and Regulations in conjunction with the general policies and procedures of the property were created to provide equitable guidelines for all parties.
